"DEJA BLUE" Vacation Rental Agreement - Terms and Conditions

The lease is between the lessee/guest and KNP LLC/lessor.

This is your short-term vacation rental agreement. This agreement outlines everything you need to know about our rental policies for our property. Our goal is to ensure that your stay at our property is wonderful and meets all of your expectations. Please let us know if you have a technology or equipment issue during your stay and we will get it resolved. If you have any questions, please email or call us.

RENTAL AGREEMENT: This Agreement constitutes a contract between the Guest (you, your) and Owner (us, we, our, KNP LLC) of the Vacation Rental Property (DEJA BLUE). By signing this agreement (electronically signed upon booking), you and your guests are agreeing to all terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property.

CONFIRMATION AND RESERVATION: Your reservation is confirmed when we receive your electronically signed rental agreement and an advance payment. The name on this agreement must be an adult who is at least 25 years old, and will be the responsible party for the reservation and all rental obligations.  We do not rent to Spring Breakers or Chaperoned parties.  If this is falsified you will need to vacate the premises and lose all payments made at any moment throughout your trip.  The Property Manager will check property throughout the week to ensure abidance.      

PAYMENT: An advance payment equal to 50% of total booking is required at the time of booking. The advance payment will be applied toward the rent via credit card. The advance payment is not a damage deposit. The balance of rent is due 60 days before your arrival date. Reservations made less than 60 days prior to arrival require full payment at the time of booking.

"DEJA BLUE" is ready for occupancy at 4PM (CST) local time on check in day of the lease.  The property must be vacated by 9AM (CST) local time on the ending day of your lease.

DAMAGE PROTECTION - In lieu of a Security Deposit, Accidental Damage Protection has been included for any accidental damages, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of you, the lease holder and your card on file will be charged. The purchase of the insurance still requires you to follow the check-out list outlined in the check-out details, and you must follow all terms and conditions.

RENTERS INSURANCE: You and your belongings are expressly excluded from any home insurance policy held by the owners of 4443 Clipper Cove, 32541. You understand that it is suggested that you carry renter's insurance to cover your personal belongings.  Please contact your Home Insurance Company.

ARRIVAL INSPECTION AND DAMAGES: Please complete an arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported immediately to us. In the event that damage occurs to the property, whether reported by you or found after departure, the cost of repair and/or replacement will be held from the deposit. If the amount of repair and/or replacement exceeds the deposit amount, you will be responsible for any additional costs. Additional costs for repair or replacement will be charged to the credit card on file.

CANCELATION POLICY: Cancellations made more than 60 days prior to your arrival will receive a total refund of any advance payments less a $300 cancellation fee. Cancellations made within 60 days of the check-in date will receive NO REFUND and you will forfeit any monies paid in advance, including shortened stays.  We do not offer refunds for weather related cancellations (including but not limited to Hurricanes, Tornados,Tropical Storms etc.).  We highly encourage Travel Insurance which you may add during check out.  It is up to the Guest to purchase the insurance. 

Travel Insurance Provided by TRAVEL GUARD: Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). CONDITIONS BEYOND OUR CONTROL: We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, ferry boat cancellation, loss of electricity, or loss of water. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.

PETS: NO PETS allowed on premises

MAXIMUM OCCUPANCY: The maximum number of guests is 16 (including children) If you are found in breach of this contract, you will be evicted and no money will be refunded. Only people who have registered with us as a guest may stay overnight on the property.

PROPERTY FURNISHINGS: We will provide you with a list of furnishings that come with the property. You agree to return all furniture items in a similar good condition, with normal wear and tear expected, as it was prior to the beginning of the lease term.  Do not take any property from the home, for example towels and sheets, unless designated for a purpose (ie: beach cart, toys). 

GETTING HERE: The confirmation email will state the timeframe in which we will send you details about the property, including: how to access the property, check-out procedures, community rules, and names/phone numbers of emergency contacts.

ARRIVAL AND CHECK-IN: Check-in is 4 PM local time (CST) on your scheduled arrival date. Check-in before 4 PM (CST) is not guaranteed. Once we receive full payment and a signed rental agreement, we will send you detailed check-in instructions.  Do not enter the property until check-in time unless permission was granted.

DEPARTURE AND CHECK-OUT: Check-out is strictly at 9AM (CST) local time on your Departure Date. We will provide you with check-out procedures in advance of your arrival.

CLEANING FEE: A cleaning fee is included in your total payment.  This includes a clean bed sheets, kitchen and bath towels, one-time cleaning, starter set of paper towel, Dish Washer tablets, Bar soap and Toilet paper in each bathroom.  There may be other items in unit available for your use. There is NO DAILY CLEANING in your fee.   If you need additional cleaning throughout the week, at an additional cost, it can be arranged.  If check-out procedure was not followed and there is excessive cleaning necessary, you may be charged an additional fee.   

UTILITIES: The cost of normal utilities usage is included with your stay. However, you are responsible for long-distance phone calls/faxes and pay-per view movies – your credit card will be billed for any additional charges. 

OUTDOOR KITCHEN: The Outdoor Kitchen will be clean upon arrival and there are two propane tanks (1 for Grill and 1 for Burners) please call if you run out of propane.  You may also purchase disposable grill sheets that sit right on the grill from Lowe’s.  Please practice safety when using the Outdoor Kitchen and always ensure it is turned off and gas is closed after use. 

POOL: The Private Pool is an amenity we offer for your stay but it is to be used at your own risk and under your own supervision, NO Lifeguard on Duty..  KNP LLC, and its owners are not held liable.  Gates must be closed and latched in front and back.  All children and pets must be supervised.  There are alarms on all doors with access to the pool.  These are for your family’s and friend’s safety with children and pets around.  The Private Pool is not heated (heater being installed in Fall 2017). The Crystal Beach Cottages Community Pool is Heated from March 1-October 31.  Guests of DEJA BLUE may use the Community Pool located upon entrance into Clipper Cove, Crystal Beach Cottages 6 houses down from house.  A passcode is needed to enter Community Pool, C1524.  All Guests must abide by Community Pool Guidelines; there is No Lifeguard on Duty, Swim at your own Risk.  Supervision of Children is necessary.  No Pets in Private Pool or Community Pool.  If there is an accident in the pool of vomit or a bowel movement - please call immediately and the Pool will be cleaned appropriately per State Guidelines by the Department of Health.  Accidents happen and there is no charge - unless this becomes excessive behavior.        

BEACH: The closest Public Beach Access is located at Hutchinson Street and Old Scenic 98, only 0.2 Miles from the rental homes back gate.  A double wide sidewalk leads you to the Beach Access where there is Small Parking lot, Pavilion, Bathrooms, and Outdoor Showers.  Pets and Fires are not legally allowed on the beaches, beach bonfires are allowed in counties East and West of Okaloosa County and you can have this arranged within a couple miles of the house.  To request a Beach Wheel Chair call the Destin Fire Control District 850-837-8413.  Lost & Found – per City Ordinance – items left on the beach overnight are collected and held for a week at the City’s Public Services Maintenance Yard, 3949 Commons Dr. 850-837-4242.  The City is not responsible for lost or damaged items.

MAINTENANCE and REPAIRS: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. We have an excellent maintenance team who corrects problems as soon as possible. Authorized personnel may enter the premises during business hours for purposes connected with repairs, care, or maintenance of the premises. Expect lawn care personnel and pool care on property once a week.  Please call if any maintenance items need to be addressed during your stay.

PARKING: Parking is limited to 4 medium sized cars (3 minivans/large SUV’s). GolfCarts and LSV count. You must park in the driveway – no street/sidewalk/grass parking is allowed.  No boats, RV’s, trailers, mobile homes, campers or other similar vehicles may be parked in neighborhood.  The Okaloosa County Sheriff’s Office will ticket automobiles who do not abide by the rules and you will be billed for any fines incurred by property owner. Also there is roam towing service in place for any that violate parking rules and fees will be car owners responsibility.    

NO SMOKING OR OPEN FLAMES – IN OR AROUND UNIT: No smoking is allowed inside the property. No cigarette butts may be left outside in the grass/ground/patio, balconies etc.  At anytime there is risk a fire may start due to your negligence, and you will be held liable.  No candles or open flame of any kind are allowed inside the property. Upon departure, if the cleaning company detects any evidence of smoking and/or open flames, you will be charged a $300 additional cleaning fee.

CRIMINAL ACTIVITY: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.

COMMUNITY RULES: You agree to abide by all rules governing the community where the property is located. The rules are posted inside the property and/or at the community office and are listed below. These rules are subject to change at any time. 

Crystal Beach Cottages Phase II Rental Rules & Restrictions

1) All automobiles shall be parked in driveway only. Trucks, boats, trailers, mobile homes, campers or other similar vehicles shall not be parked in neighborhood. Do not block sidewalks. The Okaloosa County Sheriff’s Department will ticket automobiles not parked according to these rules and the property owner is subject to fine by the community.

2) All vehicles must have current license plates.

3) Violators are subject to towing with no further notice.

4) Walkways, entrances and stairways shall not be obstructed or used for any purpose other than ingress and egress to the units.

5) Balconies and patios shall be used only for the purpose intended and shall not be used for hanging garments, towels, etc.

6) Animals will be the responsibility of their owners and shall be kept on a leash at all times. Animals cannot be left outside alone. Animal droppings are to be cleaned up immediately. No feeding or water containers will be permitted outside of homes. No animal may be kept which causes any annoyances of any kind to neighboring residents or their guests.

7) No littering of any kind. This includes cigarette butts.

8) No one may make or permit any disturbing noises that will interfere with the rights, comfort or convenience of other residents or guests. Quiet hours will be strictly observed from 10:00pm-9:00am.

9) No illegal activity of any kind on premises.

10) Garbage pick-up is Tuesday and Friday. Garbage containers may be placed by the street at sundown the night before and empty containers removed by midnight the day of collection. Garbage containers must be stored out of view from the street.

11) Rules for the use of the pool are posted and must be followed.

12) All guests must adhere to these rules.

INDEMNIFICATION: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.

GOVERNING LAW: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.

SEVERIBILITY: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.

FALSIFIED RESERVATIONS: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.

ACKOWLEDGEMENT: You have read and agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only!
